Terms of Service

These terms govern your use of The Class Mom (“the Service”) operated by Hotspot Digital (Pty) Ltd (“we”, “us”). By creating an account or using the Service, you agree to these terms. If you don’t agree, don’t use the Service.

The Class Mom is a communication tool for class liaisons. It lets you manage a roster, create events and reminders, and send WhatsApp messages to parents via the Meta Business API.

We may change, add, or remove features over time. We’ll give you reasonable notice of material changes that affect you.

You’re responsible for:

• Providing accurate information when you sign up and keeping it up to date.
• Keeping your password secure. You’re responsible for activity under your account.
• Ensuring you have the right to add parents to your roster and send them WhatsApp messages on behalf of your class.

When you use the Service you agree not to:

• Send spam, promotional content to parents who haven’t agreed to receive it, or messages unrelated to the class.
• Use the Service to send unlawful, abusive, harassing, or misleading content.
• Break WhatsApp’s or Meta’s business messaging policies (available at business.whatsapp.com/policy).
• Attempt to gain unauthorised access to the Service, its systems, or other users’ data.
• Resell, white-label, or rebrand the Service without our written permission.

We may suspend or terminate accounts that breach this section.

Messages you send through the Service are delivered via WhatsApp’s Business API, which is provided by Meta Platforms Ireland Limited. Your use of WhatsApp through the Service is also governed by WhatsApp’s own terms and business policies. Certain message types must use pre-approved templates; we manage these on your behalf.

If a fee applies to your plan it will be described on the Service or in a separate written agreement. Where WhatsApp message delivery incurs a per-message charge from Meta, those charges form part of the fees. We’ll give you notice before any price change takes effect for your account.

During early-access or beta periods the Service may be free of charge.

You keep ownership of everything you upload to the Service (roster, event text, messages). You grant us a limited licence to store, process, and transmit that content solely for the purpose of operating the Service for you.

Our Privacy Policy explains how we handle personal information. By using the Service you confirm you’ve read it.

We aim for high availability but we don’t guarantee the Service will be uninterrupted or error-free. Planned maintenance, third-party outages (including WhatsApp, Supabase, Vercel, or Cloudflare), or force-majeure events may cause downtime.

You can close your account at any time by contacting us. We may suspend or terminate your account if you breach these terms, if required by law, or if we stop providing the Service. On termination we’ll delete or anonymise your data as described in the Privacy Policy.

The Service is provided “as is”. We make no warranties beyond those that cannot lawfully be excluded under South African consumer-protection law. We are not responsible for third-party message delivery failures outside our control.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We’re not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited.

These terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with in the appropriate South African courts.

We may update these terms from time to time. If changes are material we’ll notify you by email. Continued use of the Service after the effective date of an update means you accept the updated terms.
